Is CBD Hemp Oil Legal in Ohio?
CBD Hemp oil is legal in Ohio as long as the product does not contain more than .3 percent THC. The state of Ohio is slowly setting up regulations for the cultivation and sale of hemp-derived CBD products. The 2018 Farm Bill legalized hemp throughout the U.S., prompting many states, including Ohio, to pass legislation regarding the sale and distribution of hemp-derived CBD. This means that consumers in the state of Ohio can use and distribute hemp-derived CBD legally. However, consumers are advised to carefully choose CBD products because some are not what they claim to be.
CBD Laws in Ohio
CBD or cannabidiol is a non-intoxicating compound derived from the cannabis plant. It is cannabis' second most abundant chemical compound, the first being THC. CBD and THC's main difference is the latter has psychoactive effects or the high associated with marijuana use.
CBD has health benefits, including its ability to minimize anxiety, seizures, pain, and inflammation. In addition, this chemical compound can be derived from either marijuana or hemp. Many countries have legalized hemp-derived CBD because of its low THC levels.
Why Some States Prohibit CBD
Prior to the late 80s, all types of cannabis products, including hemp, were prohibited by the 1970 Federal Controlled Substances Act. This ACT made cannabis a Schedule I drug, meaning it had a high potential for abuse, did not have any medicinal use, and was likely to cause addiction. Unfortunately, the Act also prevented anyone from researching the potential benefits of using cannabis.
The 2014 Farm Bill recognized the difference between hemp and marijuana. The main distinction between the two plants is their THC levels. Hemp contains less than .3 percent THC, while marijuana has higher levels of THC. To meet the legal requirements of cannabis use, CBD products must contain less than .3 percent THC.
The 2018 Farm Bill legalized hemp and removed it from the list of controlled substances. However, marijuana remains illegal in most U.S. states because of its high THC levels. Therefore, CBD obtained from marijuana is illegal, while hemp-derived CBD is legal.
The Food and Drugs Administration (FDA) regulates CBD products' labeling and their use as a food additive. However, the FDA insists that CBD, including hemp-derived CBD, should not be added to foods and beverages. Therefore, it is illegal for food manufacturers to add CBD to food products. However, CBD oil and other non-food cannabis products are legal throughout the U.S.
